Former high school football star exonerated in rape case

A rising football star in southern California whose career was brought to a sudden halt by a kidnap-rape conviction that landed him in prison was exonerated today after his accuser contacted him on Facebook recanted her story.

"I'm just thankful to be free now and have the opportunity like anybody else to thrive in life," Brian Banks told ABC News Radio today. "I'm completely overwhelmed with so many emotions and feelings all at once."

In a hearing today, Banks shook from sobbing when prosecutors said they did not object to his conviction being reversed. His mother and girlfriend who were in court shrieked with happiness.

Banks, now 26, was 17 in 2002 and "by all accounts, a rising football star," according to court documents. Many believed the 6-foot-4, 225 pound athlete was bound for the NFL. The University of Southern California, a Division 1 school, had offered him a full-ride scholarship and a slew of other schools?including Michigan State University and University of Kansas?were pursuing the middle linebacker.

"Tragically, Banks would never realize his dream of going to college and playing college football," his attorneys wrote in court documents. "A high-school acquaintance?Wanetta Gibson?shattered that dream one fateful day after she accused Banks of rape and kidnapping following a consensual sexual encounter."

When Gibson accused Banks of rape following an encounter at Long Beach Polytechnic High School, his attorneys encouraged him to plead no contest instead of going to trial before a jury and risking 41 years in prison.

His attorneys said he "chose the lesser of two evils" when he pleaded no contest. Banks was sentenced to six years, which he served and is now on parole and registered as a sex offender.

On Feb. 28, 2011, Banks' story took a dramatic turn. Gibson, his accuser, requested his friendship on Facebook. He did not accept it, but asked her if she would meet with him and a private investigator. She agreed.

"Gibson met with Banks and a private investigator and recanted her preliminary hearing testimony that Banks raped her," his attorneys wrote. She said that the two had been "making out pretty heavy," but that they did not have intercourse or "anything like that."

"Gibson said that they were just playing around, being curious about sexuality, and that the adults got involved and blew it all out of proportion," according to legal documents. "She said the adults 'put stuff in [her] head.'"

The problem was that Gibson did not want to tell prosecutors the truth because she feared she would lose the $1.5 million she and her family won in a civil suit against Long Beach schools after the incident.

The California Innocence Project, a law school clinical program at California Western School of Law dedicated to releasing wrongfully convicted inmates, took on Banks' case and won his exoneration.

The Long Beach School District did not immediately respond to questions from ABCNews.com about whether they would seek the return of the money from the civil suit.

Now, Banks is more than happy to get back to his life with a clean slate and has not given up his NFL dreams.

"I've been training since October of last year in hopes of giving football another shot," Banks said. "I'm hoping to possibly receive a try out from a team."

He is also working on a documentary about his life, according to his website. He said his family is "ear to ear with smiles."

"Everybody's just yelling and hugs and kisses," he said. "Everyone's just happy. So we all have on these 'innocent' shirts and 'exonerate' shirts."

When asked if he harbors any bitterness or anger about what happened, he said, "I've been asked that question a couple of times and my answer's always been no. You know I can hold on to that, that bitterness and that anger. It won't get me anywhere."

LOS ANGELES (AP) ? Even robots like to have fun. NASA's rover on Mars showed off its playful side by snapping a picture of its own shadow. It's the latest self-portrait since the rover, named Opportunity, landed on the red planet in 2004.

The photo was taken in March and NASA released it this week. The solar-powered, six-wheel rover was at an outcrop on the rim of a massive crater. The late afternoon sun set the crater aglow and Opportunity waited for just the right lighting to send a postcard back to Earth.

The result was a dramatic view of Opportunity casting a shadow with the crater in the background.

After nearly five months in one spot, the tireless rover is rolling again to explore more rocks.

Its twin, Spirit, stopped communicating in 2010.

Away from presidential race's glare, battles for Congress rage

SCHAUMBURG, Illinois (Reuters) - Republican Representative Joe Walsh was campaigning recently at a diner in this Chicago suburb when he came across an elderly woman who rebuffed his charms.

"You're tough. Shake the hand!" the energetic House freshman said, before asking: "Who got us into this mess?"

"Republicans," the woman answered, without missing a beat.

Walsh is no stranger to opposition. Backed by the conservative Tea Party movement, he was elected in 2010 by just 292 votes (out of more than 202,000 ballots cast) and joined a class of first-term Republicans whose resistance to compromise was a hallmark of a dysfunctional Congress.

Now he is in one of the nation's most-watched congressional races, facing Tammy Duckworth, a decorated Iraq War veteran backed by Democratic President Barack Obama's closest allies.

The battle in Illinois' 8th District is among several that will reshape Congress while unfolding beyond the glare of the presidential race between Obama and Republican Mitt Romney, who will focus mostly on 10 other politically divided states that are likely to decide who wins the White House.

Aside from attending fundraisers, Obama and Romney are unlikely to spend much time campaigning in Illinois, California and New York. Those states are widely seen as solidly in Obama's column for the November 6 election and they are where vulnerable U.S. House incumbents - mostly Republicans - face big challenges.

The story is similar in more conservative states such as Kentucky and Georgia, where Romney is expected to win in November and where a few Democrats fighting to stay in Congress are unlikely to get much help from Obama.

House Speaker John Boehner, an Ohio Republican, calls them "orphan districts" - places where embattled House incumbents will not be able to feed off the attention that is generated when their party's presidential contender visits their district.

These districts may be out of the limelight but they are hardly forgotten.

The stakes are such that both parties have created programs to direct funds to vulnerable incumbents in the districts. Meanwhile, independent "Super PACs" that are preparing to spend millions of dollars on congressional races are planning ad campaigns to attack and support candidates in "orphan" districts.

Boehner has warned his party about the vulnerability of Walsh and other Republicans in mostly Democratic states.

Democrats need to gain 25 seats to retake control of the 435-seat House, a feat most analysts say they will not achieve.

But if there is a narrow path for Democrats to win back the House, it will run through states that are relatively distant from the heat of the 2012 presidential campaign.

"We have 50 (Republican) members in tough races, 89 freshmen running for their first re-elections, and we have 32 that are in states where there is no presidential campaign going to be run," Boehner recently told Fox News. "You take 18 of them, (in) California, Illinois and New York, where you know we're not likely to do well at the top of the ticket. Those districts are frankly pretty vulnerable."

SEEKING MOMENTUM

Both parties have created programs to direct campaign funds to vulnerable incumbents.

Of the 34 Republican incumbents receiving money under the party's Patriot program, 20 are in states outside the key battleground states in the presidential race: Virginia, North Carolina, Florida, Ohio, Nevada, Pennsylvania, Colorado, Iowa, Arizona, and New Hampshire.

A similar program for vulnerable Democratic incumbents, known as Frontline Democrats, is helping to fund 17 House members - eight from states that are not key battlegrounds in the presidential race.

Thanks to the uncertain economy, Republican strategists believe Obama's presence on the ballot will not have the same impact as in 2008, when he rode a wave of support among youths and minorities to become the nation's first black president.

At the same time, Republicans acknowledge that they probably will not repeat their success in 2010, when they picked up 65 House seats, the biggest shift in that chamber since 1938.

"We're realists," said Guy Harrison, executive director of the National Republican Congressional Committee. "We know that it may not be 2010. But it's definitely not going to be 2008."

For Democrats, the fight to unseat Walsh is a key part of making up for the debacle of 2010.

"Illinois will be pivotal to our prospects of gaining the majority in the House," said New York Representative Steve Israel, chairman of the Democratic Congressional Campaign Committee.

'HAPPY-GO-LUCKY IRISH BOY'

In Illinois, Obama's home state, Democrats like their chances in four congressional districts that were won by John Kerry and Obama in the last two presidential elections but that now are represented by Republicans - three of them elected in 2010.

Three of the districts are in the Chicago suburbs and of those the most compelling contest is between Walsh and Duckworth.

A community of well-kept lawns and Saturday morning Little League baseball games, the 8th District emerged from the recession with unemployment rates well below the national average. Despite Democrats' hold on Chicago, the district's communities often vote Republican.

Walsh, 50, a former teacher and investment banker, channeled the Tea Party movement's aggressive brand of dissatisfaction two years ago in knocking off Democratic incumbent Melissa Bean.

"There's very little subtle about me," Walsh said during a debate against Duckworth.

Walsh is known for sleeping in his Washington office. When he campaigns, he drives around with his dog Bella in a 1984 motor home, featuring signatures from supporters on the outside and shag carpeting inside.

At a town hall meeting in Bloomingdale last week, Walsh yelled about the threat created by the federal debt. He said his sunny disposition has been changed by the times.

"I'm a happy-go-lucky Irish Catholic boy," Walsh said. "This is not me."

'I SHOULD BE DEAD'

While Walsh stresses the ills of government, Duckworth speaks about the good it can do.

A former U.S. Army helicopter pilot, Duckworth, 44, lost both her legs and part of her right arm when a rocket-propelled grenade hit her Black Hawk helicopter in Iraq in 2004.

"I should be dead," Duckworth told supporters recently. "I took an explosion in my lap. My buddies triaged me as dead."

As she talked, Duckworth tucked one titanium leg, painted with the colors of the U.S. flag, under the other, which is painted with a camouflage design.

Since leaving the Army, Duckworth ran unsuccessfully against Republican Rep. Peter Roeskam and served in the Illinois and U.S. Veterans Affairs departments. In an interview, Duckworth recounted being in Washington last spring, preparing to help close the V.A. under the threat of a government shutdown.

"I was sitting in my office in Washington when Joe Walsh and the Tea Party tried to shut down government" in a standoff over the federal budget, she said. "It pissed me off."

BACKING 'A FIGHTER'

In congressional districts where the presidential campaigns have little presence, independent groups - including those known as "Super PACs" - are starting to direct hundreds of thousands of dollars to support and attack candidates.

This month, the U.S. Chamber of Commerce began airing ads in 17 House districts. In all cases but one, the ads were aimed at boosting Republicans or attacking Democrats. Seven of the ads are airing in New York.

"The parties' preoccupation with the presidential (race) will make many of these orphan seats a more attractive place for outside groups to invest," said Jonathan Collegio of the conservative American Crossroads PAC, which plans to spend up to $100 million to boost Republicans in congressional races.

A much smaller operation, the CREDO Super PAC, is targeting what it sees as "extremist" Tea Party conservatives and has set up an office in Walsh's district.

"He's too crazy to be in office," said CREDO President Becky Bond, whose group plans a modest local campaign against Walsh.

Some voters in Walsh's district like his spirit.

After meeting Walsh at Checker's Pancake House in Schaumburg, Pat Kole, 58, who recently lost her job as an administrative assistant, said Walsh had her vote.

"I don't know what he's done," she said. "But I know he's a fighter."

HTC One XL coming to Germany on Vodafone, O2 and T-Mobile

HTX One XL

The HTC One XL has graced the Far East, Australia and North America (under the name HTC One X), and now it's headed to Europe, with today's news that Vodafone Germany will launch the device next month. The One XL is almost identical to the international One X, except that it sports a 4G LTE radio and dual-core Snapdragon S4 chip instead of the Tegra 3 found in the One X. (That's due to Tegra 3's lack of support for LTE.)

Basically, this is an AT&T One X for Europe, with European LTE bands. In addition to dual-band HSPA on 900 and 2100MHz, the Euro One XL supports LTE on 800, 1800 and 2600MHz bands. This means it'll also run on the UK's 4G LTE networks, whenever they're launched.

The One XL will launch in Germany on Vodafone, T-Mobile and O2, and there'll also be unlocked SIM-free version available. Prices reportedly start at €659 (~$830).

'Deadliest Catch' features dramatic airlift rescue

By calling it "Deadliest Catch," Discovery was obviously setting up audiences for some serious drama from the cast of its reality show about Alaskan king crabbing boats and their crews. But after revelations of drug usage and the shocking deaths of the captain and a new deckhand, it seemed like this show might have more drama than it could handle.?

Nope -- last night's show proved there's still plenty to offer from the high seas, as the episode picked up where it left off last week with harrowing footage of Wizard crew member Chris Scambler, who suddenly fell ill. The greenhorn had been struck down with shooting pains in his neck and arms, which quickly turned into convulsions. Without a doctor on the boat, he had to be airlifted by the Coast Guard to take him to an Alaskan hospital.

The story was reported last year by AP, but at the time the crewmember was not identified. The clip above reveals?that Scambler was the 28-year-old crewman referred to in the original story. Scrambler was reported to be suffering from dehydration and shock, and was eventually moved to Anchorage and stabilized.?

"I'm sorry," Chris said as he was being prepped for removal.?

"Don't be sorry, man, you did a great job for me," Capt. Keith Colburn told him. "All right?"

Everest will be crowded again days after 4 killed

KATMANDU, Nepal (AP) ? Days after four people died amid a traffic jam of climbers scrambling to conquer Mount Everest, Nepal officials said a similar rush up the world's tallest peak will begin soon, and there's little they can do to control it.

About 200 climbers are expected to attempt to scale the summit of the 8,850-meter (29,035-foot) mountain between Friday and Sunday, Nepali mountaineering official Gyanendra Shrestha said. Some have been at a staging camp for days, waiting for a window of good weather during this worse-than-usual climbing season.

A similar crowd of 208 climbers headed to the summit last week, and four died Saturday in one of the deadliest days ever on the mountain.

Ha Wenyi of China, Eberhard Schaaf of Germany, Nepal-born Canadian Shriya Shah and South Korean Song Won-bin died on their descents from the summit, apparently from exhaustion and altitude sickness.

Shrestha also said a Nepalese Sherpa guide who had been reported missing reached the base camp safely on Monday. The guide was separated from his group and did not have communications equipment, Shrestha said Tuesday.

The deaths have raised concerns about overcrowding above the highest camp on the mountain. The area is nicknamed the "death zone" because of the steep icy slope, treacherous conditions and low oxygen level.

Describing a "traffic jam" of climbers Saturday, Shrestha said climbers were heading to the summit at 2:30 p.m., even though 11 a.m. is the latest start time recommended. That meant climbers were staying too long at high altitudes and exhausting their oxygen supplies because they didn't anticipate having to wait.

Now, with a similarly large number of climbers expected to head up the same trail under similar conditions, Nepalese authorities acknowledged safety concerns but said they can't turn any of them away.

"The climbers have received the permits to climb within specific dates. We cannot say who gets to get to the summit on which dates because of the unpredictable weather. When weather clears up they all want to benefit," said Nepal's Tourism Ministry spokesman, Bal Krishna Ghimire.

Apa, a Nepalese Sherpa guide who has scaled Everest a record 21 times, said climbers are eager to reach the summit, so when the weather clears up they take their chances.

"The window of good weather is so short that if the climbers miss it then there is a good chance they will not be able to get another chance, so they don't want to wait and take their chances," said Apa, who uses only one name.

He said the traffic jam of climbers going up and down the same icy trail makes it hazardous, especially with climbers already exhausted from having climbed all night from the last camp, at 8,000 meters (26,246 feet).

"And having to wait for extra hours and the delays only makes the situation worse," Apa said.

Ghimire said it is up to the climbers and their teams to access the conditions and safety.

"We have officials at the base camp, but beyond that it is mostly up to the climbers," Ghimire said.

He said that eventually, the government plans to set up a seasonal office at the base camp equipped with doctors, weather experts and security personnel. Ghimire said they also have plans to give each climber a tracking device.

More than 3,000 people have climbed Everest since Edmund Hillary and Tenzing Norgay became the first to do it in 1953. Some 225 climbers have died attempting it.

The deadliest day was May 10, 1996, when eight people were killed. The main reason was said to be that climbers who started their ascent late in the day were caught in a snowstorm in the afternoon and lost their way.

The climbing season normally runs from late March to the first week in June, but this year the season's first clear conditions were on Friday and Saturday. A windstorm hit the higher altitudes by Saturday afternoon.

If you?re not keeping track of the ?legal high? scene it?s important to remember that the first examples, synthetic cannabinoids sold as ?Spice? and ?K2? incense, were only detected in 2009.

Shortly after amphetamine-a-like stimulant drugs, largely based on variations on pipradrol and the cathinones appeared, and now ketamine-like drugs such as methoxetamine have become widespread.

Since 1997, 150 new psychoactive substances were reported. Almost a third of those appeared in 2010.

Last year, the US government banned several of these drugs although the effect has been minimal as the legal high laboratories have over-run the trenches of the drug warriors.

A new study just published in the Journal of Analytical Toxicology tracked the chemical composition of legal highs as the bans were introduced.

A key question was whether the legal high firms would just try and use the same banned chemicals and sell them under a different name.

The research team found that since the ban only 4.9% of the products contained any trace of the recently banned drugs. The remaining 95.1% of products contained drugs not covered by the law.

The chemicals in legal highs have fundamentally changed since the 2011 ban and the labs have outrun the authorities in less than a year.

Another new study has looked at legal highs derived from pipradrol ? a drug developed in 1940s for treating obesity, depression, ADHD and narcolepsy.

It was made illegal in made countries during the 70s due to its potential for abuse because it gives an amphetamine-like high.

The study found that legal high labs have just been running through variations of the banned drug using simple modifications of the original molecule to make new unregulated versions.

New, unknown and poorly understand psychoactive chemicals are appearing faster than they can be regulated.
