Man charged with defacing Rothko painting in London

LONDON (Reuters) - A Polish man has been charged with criminal damage after a painting by Russian-American artist Mark Rothko was defaced in London's Tate Modern museum, police said on Tuesday.

Wlodzimierz Umaniec, 26, who is also known as Vladimir Umanets, is accused of damaging Rothko's 1958 canvas "Black on Maroon" on Sunday.

The words "Vladimir Umanets, a potential piece of yellowism" were daubed in black onto the bottom-right corner of the painting.

Witnesses said a man calmly approached the Rothko painting in the Tate before marking it. The museum said it would be repaired by an in-house team of experts.

Rothko, a key figure in 20th century abstract painting whose works sell at auction for tens of millions of dollars, was commissioned to paint the Seagram Murals in the 1950s for the Four Seasons restaurant in New York.

Several of them ended up in the Tate collection after being given as gifts, and Tate describes the series of soft-edged, coloured rectangles as "iconic".

In May, Rothko's "Orange, Red, Yellow" sold for $86.9 million, a new auction record for the artist, at Christie's in New York.

Police said Umaniec was due to appear at London's Camberwell Green Magistrates' Court on Wednesday charged with one count of criminal damage in excess of 5,000 pounds.

After missing UFC on FX 5 bout, Jeremy Stephens is still in jail

Jeremy Stephens had to miss his UFC on FX 5 bout because he was arrested on an old warrant while in Minneapolis for his fight with Yves Edwards. As of this writing, Stephens is still in jail and will have the chance to see a judge on Tuesday afternoon. His bail is set up $100,000, and he faces extradition to Iowa.

The arrest came not long before Stephens was supposed to face off with Edwards. Though UFC president Dana White insisted that the fight would go on despite Stephens being in jail, the fight was eventually called off. White said he spent the whole day trying to secure Stephens' release, but he said to MMA Fighting that he couldn't get the fighter out of jail in time for the fight.

"I cut the deal with people down in Des Moines, Iowa, to get him out. I accept that deal too. They changed the deal. Every time I accepted the deal, they kept trying to make it harder and harder and harder. You know me, especially after I tweeted the media to shut up, I was devising a plan to break him out and get him over here to come out and do this fight. So, they finally made this deal for an astronomical amount of money to make the deal, and I agreed to it, and then they did it again. So they're going to stick it to this kid big-time when he gets to Iowa."

Stephens' management team said the felony charge has to do with a party he attended in 2011. There was a fight at the party, and Stephens' name came up in the investigation. Though Stephens arrived in Minneapolis five days before his fight and attended the public weigh-ins, they're not sure why he wasn't arrested until the morning of the fight card.

The beauty of the accused unfairly affects perceptions of their culpability

A study from the University of Granada based on police surveys indicates that in domestic violence crimes in which the woman kills her abuser, if she is more attractive she is perceived as guiltier.

From a social psychology point of view, it has been noticed that physical attractiveness has an influence on how people are perceived by others in labour, academic and even legal fields. On the one hand, this creates the mental association of "what is beautiful is good". On the other hand though, when it comes to domestic violence the results are different.

"One of the most interesting conclusions of the study was that when the woman accused of killing her abuser was attractive, participants attached greater culpability, whereas if considered 'unattractive', this decreases," as explained to SINC by Antonio Herrera, Inmaculada Valor-Segura and Francisca Exp?sito, the authors of the study published in The European Journal of Psychology Applied to Legal Context.

For the purposes of the study, two types of 'mock' stories about legal proceedings were invented in which the defendant was a woman accused of killing her husband. Her defence was that she had suffered prolonged domestic violence and thus acted in self-defence when killing him. In one of the stories the description of the woman coincided with the prototypical battered woman but in the other it did not.

"Therefore, half of the participating police officers read the story in which the accused is young, battered, physically deteriorated and fragile. She has children and is financially dependent on her partner. The other half read a story in which the woman is childless, she works as a financial consultant, she has been married for 10 years and during legal proceedings she is well-dressed and resolute and calm in her interactions with the judge and lawyers," explain the authors.

The researchers asked the participants to take on the role of the jury and answer a series of questions related to their perceptions of credibility, responsibility and situation control generated by the descriptions of the women. They were also asked about their sexist ideology.

The prototype of the battered woman

The authors outline that one of the variables having the greatest effect on the woman's perceived criminality rating is whether or not she fits the stereotype of the battered woman. This is named prototypicality.

"The results showed that when dealing with a non-prototypical battered woman (in other words, someone who does not conform to society's idea of such women), they were seen to have more control over the situation, which in legal terms can translate as a higher degree of guilt," confirm the researchers.

Another variable linked to the 'jury's' judgement on the case was the level of participant's sexism. In this respect, those who scored higher in their hostile rating (also called traditional sexism or machismo) attached more situational control to the accused.

"Despite its possible limitations, this study warns of the need to increase training related to the handling of domestic violence cases for all law enforcement officers and police. Their work is fundamental in the process and can be conditioned by external variables, such as physical attractiveness or stereotypical beliefs of domestic violence," conclude the authors.

The sample used in the study comprised 169 police officers from the Spanish State Security Forces. They were taken from different cities in Spain and the majority of participants were men (153 men and 16 women).

Stop Building Bombs and Start Building Starships

In 1969, a great shadow was cast over the United States. That shadow, however, was not one of gloom. Instead of evoking the absence of light, this shadow caused us to look up in wonder at the brightness that created it. When the Saturn V Rocket propelling Apollo 11 astronauts Neil Armstrong, Buzz Aldrin, and Michael Collins dashed across the blue, cloud-splotched sky, we did not see a dark present. We glimpsed a bright future.

Elsewhere, however, truly ominous shadows were cast by rockets which never saw the sun. Nestled in silos and buried beneath barren landscapes, ?Minuteman? missiles meant not to uplift man, but to deliver the end of man, shrouded much of our world in trepidation.

These two rockets, with two very distinct purposes, bring into focus a problem that has long plagued our nation. We spend far too much money on war, and not enough on science.

Considering that we are nearing the ominously titled ?fiscal cliff? ? a series of government spending cuts and tax increases that will automatically take effect if Congress and the President do not act to stop it ? we have a unique opportunity to review Federal spending and ensure that we are investing our time and wealth to their most productive ends.

I argue that such a review ? if guided by reason ? would reveal that defense spending should be reduced in order to make way for a world-changing commitment to science and technology, a bold move that will put both the United States and the world on a path to a bright future.

As it stands today, the United States is clearly over militarized. Defense spending in 2011 was estimated at $711 Billion. That?s equal to the combined budgets of the next fourteen top-spending countries, over half of whom are strong U.S. allies. Moreover, a 2011 Government Accountability Office audit of defense spending found that a combined $70 billion was wasted in 2010 and 2009.

This over-the-top spending is indicative of a military-industrial-complex run amok, precisely the scenario that President Dwight D. Eisenhower, perhaps the most revered military commander of the 20th century, warned against in his farewell address. ?Together, we must learn how to compose differences not with arms, but with intellect and decent purpose,? he avowed.

I can think of no better way to fulfill Eisenhower?s vision than through the pursuit of science.

By intelligently, purposefully, and gradually drawing down the defense budget from 4.7% to 3.0% of GDP (from $709 to $453 billion), and diverting some of those funds to meaningful science projects of both national and global significance, the United States can accomplish the essential goal of protecting its citizens, while simultaneously making the world a safer, healthier place and reinvigorating our economy.

We can begin the funding transition at home by re-committing ourselves to NASA. If we double the space agency?s budget (currently at $17.8 billion), our space accomplishments in ten years will dwarf even the monumental success of this summer, when the Curiosity rover landed on Mars.

We can complete the James Webb Space Telescope, allowing us to peer farther into the Universe than ever before. We can go to Mars by the end of the decade, a mission which astrophysicist Neil deGrasse Tyson insists ?would reboot America?s capacity to innovate as no other force in society can.? And with the recent news that warp drive may be more feasible than originally thought, we can focus on researching and eventually engineering interstellar starships that could one day take humans to Gliese 581 g ? a potentially habitable Earth-like planet ? in a mere two years. Along the way we could solve a myriad of other problems, writes Space.com?s Clara Moskowitz:

??if human beings can solve the challenges of interstellar spaceflight, in the process they will have solved many of the problems plaguing Earth today, experts said. For example, building a starship will require figuring out how to conserve and recycle resources, how to structure societies for the common well-being, and how to harness and use energy sustainably.?

In addition to funding NASA, we can make fusion energy research a top national priority. Fusion power ? an unparalleled energy source that generates electricity by effectively creating a miniature star ? has eluded scientists for decades, but researchers now believe that successful fusion is within mankind?s grasp. Before the year is out, scientists at the National Ignition Facility in California hope to fire the world?s most powerful laser into a small test chamber with pea-sized fuel pellets of deuterium and tritium inside. The two isotopes of hydrogen will fuse together and potentially create up to one hundred times more energy than was used to ignite the fuel.

This breakthrough could serve as our ?Sputnik Moment? for energy production. If we can put a man on the Moon a mere eight years after deciding to do so, then surely we can master ?star power? if we pledge ourselves to the task. Fusion produces no carbon emissions, could provide power for thousands of years, is estimated to be cost-competitive with coal, and is unquestionably the energy source of the future. Yet despite the impressive resum?, fusion energy research is only allotted a relatively paltry $474.6 million. Why wait for the future to happen later? With additional spending freedom by making cuts in defense, we can fund fusion and make that future happen now.

Abroad, armed with science, the United States could make an even bigger difference. Instead of paying $1 billion for a new B-2 bomber or $2 billion for a Virgina Class Submarine ? tools designed to forcefully combat the symptoms of the world?s problems ? we could pay less and actually work to solve those problems. We live in a new age where people can collaborate as never before, working cooperatively across previously insurmountable barriers of distance and language. In this modern age, we don?t need an army of soldiers; we need an army of scientists.

The United States should spearhead a global public-private coalition with the aim of using science and technology to solve the pressing problems of the present and the surfacing challenges of the future. Partner countries will join and lend funding as well. Such a program could recruit scientists from around the world and form them into separate divisions, each tasked with an individual goal, such as curing disease, solving the emerging water crisis, or spreading modern agriculture practices.

Effective communication and outreach on an unprecedented scale will be paramount to the project?s success. This must involve on-the-ground collaboration with local governments, scientists, and stakeholders, especially in the Global South and the Third World. Solving global problems will need to be reconciled with local priorities.

Such an initiative would be a boon, both foreign and domestic. It would create jobs, spur innovation, foster global goodwill, and boost the world economy. It may also result in revolutionary discoveries that would eliminate many of the primary causes of conflict and war. In a world fortified by scientific discovery, there would simply be no need for exorbitant defense spending.

After reading this proposal, it?s natural to be somewhat incredulous. The undertaking that I have outlined is bold and would require the type of political consensus that we haven?t seen in well over a decade. But it is not wistful, nor is it too costly or overly naive. It can be done.

Setting our defense spending at 3.0% of GDP is far from unprecedented; it?s the same level we had during President Clinton?s second term. And the notion of aiding the developing world through a massive, coordinated scientific endeavor was also previously conceived. In 1961, President John F. Kennedy entertained a proposal to undertake a large-scale irrigation project to benefit the Third World. Instead, he chose an equally worthwhile enterprise: going to the Moon.

That courageous expedition ? conducted in the midst of a Cold War with the Soviet Union and a hot war in Vietnam ? proved that Science can be mightier than the Sword. In the decades that followed, we have forgotten this. It is time to remember it.

Living room built around NYC Columbus statue a hit

NEW YORK (AP) ? Anyone hoping to commune with Christopher Columbus on Columbus Day will be disappointed: He's booked solid. Monday's tickets to the conceptual art installation that surrounds a 13-foot statue of the explorer with a well-appointed living room have all been snapped up.

The exhibit, "Discovering Columbus" by Japanese artist Tatzu Nishi, has become a must-see cultural attraction in New York since it opened Sept. 20. Some 20,000 people have made the walk up six flights of stairs for the up-close view of Columbus, as well as the unique views of Midtown Manhattan and Central Park.

"Living room in the sky? I thought 'Cool. Check it out,'" said business analyst Brianna Goodman, who visited this past week. "I would never have thought to build a living room around a statue, but it made it like an intimate setting. And then the view from up there!"

Artist Martha Bone said the walk up and down the stairs was well worth it. "It was one of the best installations I've ever seen. ... It's my city. I like to know what's going on in it."

The exhibit is being presented by the city's Public Art Fund, and free timed tickets can be reserved at www.publicartfund.org. Another 80,000 are slated to see the exhibit before it ends Nov. 18.

"What I have been absolutely thrilled about is that I think the project has really captured the imagination of New York," said Public Art Fund director Nicholas Baume.

Not everyone is a fan. John Mancini, executive director of the Italic Institute of America, said the artwork turns the 1892 statue by Italian sculptor Gaetano Russo into "a stage prop."

"How can one artist hijack the work of another artist?" he complained.

The statue rests on a 60-foot granite column at the southwest corner of Central Park. Columbus' marble features usually are visible only from afar.

For his first installation in the United States, Nishi has perched Columbus' home atop scaffolding that encases the column.

The statue rises out of a large coffee table so that it seems to preside over a highbrow salon. Pink wallpaper, designed by the artist, depicts American icons Elvis Presley, Marilyn Monroe and Martin Luther King Jr.

Because Time Warner Inc. and Mayor Michael Bloomberg's media company are sponsors, the magazines include Bloomberg Business Week and the TV is on CNN with the sound on low. Fresh newspapers are laid out every day

Visitors can plop themselves on the sectional, admire the views and scan the titles on Columbus' bookshelves, which include Walt Whitman's "Leaves of Grass," Barack Obama's "The Audacity of Hope" and books about baseball and American history.

"I was really enjoying trying to figure out who are these people who live in this apartment," said art therapist Bonnie Hirschhorn. "I was picturing some New York City intellectual."

(AP) ? Patsy Bivins tossed and turned all night after finding out the steroid shot she received to ease her chronic back pain could instead threaten her life.

For now, all the 68-year-old retired waitress can do is hope she doesn't develop the telltale signs of a rare form of fungal meningitis that health officials say has sickened more than 60 people in nine states: a splitting headache, fever, stiff neck, difficulty walking or worsening back pain. There may be hundreds or even thousands more like her.

She called her doctors Friday, right after her first cup of coffee, hoping to relieve the anxiety stirred a day earlier when she learned she might be at risk. Bivins was told only that she didn't need to be checked unless she developed symptoms.

"I'm not sure if I like it," Bivins, of Sturgis, Ky., said Friday in a telephone interview with The Associated Press. "Seems like there should be some way to tell it before you get the symptoms. Honestly, it makes me worse than I was."

Federal health officials say seven people have died so far, and they fear thousands more could have been exposed. The Centers for Disease Control and Prevention has said the outbreak may have been caused by a steroid made by a specialty pharmacy in Massachusetts, where inspectors found at least one sealed vial that was contaminated. It's not yet clear how the fungus got into the steroid, which is commonly used to treat back pain. But officials have told health professionals not to use anything made by the pharmacy.

So far, the government has identified about 75 facilities in 23 states that received the recalled doses. It is not yet clear exactly how many people could get sick, though health officials say the fungus is not transmitted from person to person.

The CDC has called for clinics and doctors to immediately identify those who could have been exposed between July 1 and Sept. 28. It could be weeks before any of the patients are in the clear.

"Sure I'm apprehensive, but there's not a thing I can do except wait and see what happens," said Richard Jenkins, an 81-year-old from Nashville who received his most recent shot Sept. 11 at the Saint Thomas Outpatient Neurology Surgery Center.

The chief medical officer for the Tennessee Department of Health said Friday the incubation period for the disease isn't yet known and he advised at-risk patients to be vigilant for symptoms for weeks.

"A month is the shortest we'd possibly want to consider that. We're looking at a longer period of time before we'd feel confident that somebody is out of the woods," Dr. David Reagan said.

The company at the center of the outbreak, the New England Compounding Center, had been investigated by Massachusetts regulators in 2006. That led to an agreement for a full inspection of its drug compounding practices, including sterility.

A spokesman for NECC said the company would have no further comment Friday. It has previously said that it is cooperating with health investigators to determine the source of the infections.

Bivins, a widow who lives in western Kentucky about an hour from Evansville, Ind., received two injections in her lower back on Aug. 27. It was the first time she had received steroid injections and the constant pain in her lower back, hips and legs was eased.

She said she doesn't blame the doctors ? they were just trying to help her, not knowing the steroid could have been contaminated. She was told Thursday by Our St. Mary's Surgicare Cross Pointe facility in Evansville, Ind., that she could be at risk, which made for a restless night. For now, she tries to pass the time by arranging things in the apartment she moved into a few days ago.

"I can't sit around here and dwell on it all the time and go nuts," she said.

Microsoft may surprise music fans with October launch

Microsoft took a lot of the sizzle out of its scheduled product launches in October by announcing the products months before consumers could get their hands on primetime versions of them. However, Redmond may be playing a surprise card when it rolls out Windows 8 and its Surface tablets at midnight on October 26.

That surprise card is a new music service tied to Microsoft's gaming platform, Xbox. While Microsoft has confirmed that it has a music service in the works called Xbox Music to replace its old Zune Music Pass, the company has been less than forthcoming with details about the new service.

Following reports last week that Xbox Music will debut with other new products on October 26, Microsoft pushed out to the press a statement long on enthusiasm and short in detail. It said:

?We?re not commenting on speculation around Xbox Music. What we can say is we?re excited for Xbox Music as our definitive music service. It?ll bring great new ways to enjoy, share and discover new music on all your Windows 8 devices, Xbox 360 console, and Windows Phone 8. We?ll let you know when we have more information to share."

Despite Microsoft's attempts to keep a lid on information about the new music service, unconfirmed tidbits keep surfacing. For example, The Verge, citing sources familiar with Microsoft's plans for the service, said Xbox Music would have both a paid and free component.

The service will run on all Microsoft devices, the report says, and eventually, on Android and iOS hardware, although that won't be the case at its initial release.

Xbox Music will reportedly be supported in the new dashboard for Microsoft's gaming console, as well as in updates to music and video apps for Windows 8. Integration with Microsoft's cloud storage service SkyDrive, for storage of music and playlists, are also be an important component of the new service, according to the report.

News that Xbox Music will contain a free component similar to Spotify complement reports that Microsoft is engaged in negotiations to acquire Internet music provider Rdio. Rdio is a competitor of Spotify that offers a paid streaming music service.

Neither Microsoft nor Rdio is commenting about any potential deal. The acquisition, though, would make sense for both companies. Rdio could use Microsoft's resources to be more competitive against Spotify. Microsoft could use Rdio to further its plans to make Xbox Music a cross-platform agnostic service.

Meanwhile, on the paid side of things, last month a "leaked" subscription screen allegedly for Xbox Music appeared on the Internet. It shows that the service can be tried free for 30 days, with a month's use priced at $9.99 and an annual subscriptions at $99.90.
